COVID-19 LIABILITY RELEASE WAIVER

COVID-19 SAFETY INFORMATION:
The novel coronavirus, COVID-19 and its variants (“COVID-19”), was declared a worldwide pandemic by the World Health Organization. COVID-19 is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even through respiratory droplets. People reportedly can be infected and show no symptoms and therefore spread the disease. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
The U.S. Center for Disease Control and State Public Health Authorities where the Event is held have set recommendations, guidelines, and some prohibitions which The Open Group, adheres to comply. These include the requirement to wear face masks throughout the enclosed convention halls and meeting rooms. Hand sanitizing stations will be located throughout the venue, both inside and outside. All participants are expected to abide by the safety measures, in consideration of each other and the staff.
The Open Group cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending its conferences and/or entering onto premises where The Open Group events are held. Even with some measure of upgraded air filtration and UV technology that our contracted venues may have installed to minimize the transition of infectious disease, these do not necessarily cover all areas where you may visit. It is not possible to completely prevent against the presence of the disease. Therefore, if you choose to attend the Event and enter onto the Venue premises where its conferences and exhibits are held, whether you are vaccinated or not, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
In consideration of my participation in the foregoing, I acknowledge and agree to the following:
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I am fully and personally responsible for my own safety and actions while and during my participation in the Event. I understand and am aware that my participation in the Event involves risk, including, but not limited to, travel, physical activity, locales where public health and safety may be at risk, or activities that involve risk that I create for others or others may create for me. I am also aware that there are risks that I may not have considered, yet I waive my right to any claims that may occur from these unconsidered risks because attending in person is of personal and professional value to me.
RELEASE AND LIABILITY WAIVER: With full knowledge of the risks involved, I hereby release, waive, discharge The Open Group, the property or site owner of the Venue and their board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, exposure, infection spread of COVID-19 or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.
I agree to indemnify, defend, and hold harmless The Open Group, the property or site owner of the Venue, their respective board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death (whether known or unknown, foreseen or unforeseen or that occur now or in the future) from or related to COVID-19.
This Agreement is governed by the laws of the Commonwealth of Massachusetts.
